Thank you for visiting Eve Lom at www.evelom.com (the "Site").  The Site is owned and operated in the United States by Space Brands USA LLC ("SB" "we" "us" or "our"). SB values its customers and respects their privacy. Your visit to the Site and your use of any of the services or features we provide is subject to our terms and conditions of which this privacy policy is part. This privacy policy (together with our Website Terms of Use and any other documents referred to on it) describes our treatment of information which may be used, directly or indirectly, to identify an individual (“personal information”).  This includes personal information we collect online when you visit the Site.  Please read the following carefully to understand our views and practices regarding your personal information and how we will treat it.

This privacy policy does not cover information that you submit on other websites, even if we communicate with you on those sites.  For example, if you post something on Facebook, Twitter, Instagram or YouTube, that information is governed by the privacy policies on those websites, and is not governed by this privacy policy.  

Information we collect

We collect, or have in the last 12 months collected, the following general categories of personal information:

  • Personal identifiers such as name, alias, postal address, unique personal identifier, online identifier Internet Protocol address, or email address;
  • Financial information, such as your bank account name, credit or debit card information, or related financial information;
  • Commercial information, such as purchasing or consuming tendencies;
  • Internet or other electronic network activity information;
  • General geolocation information; and
  • Inferences based on the information listed above.

Information you give us. You may give us information by filling in forms on our Site or by corresponding with us by phone, e-mail or otherwise. This includes information you provide when you: 

  • Register to use our Site (which you must do if you would like to use some of the services and features we offer on our Site);
  • Subscribe to our services;
  • Place an order on our Site;
  • Post content to the Site through reviews or comments; and
  • Visit our social media platforms (which would include your name, profile picture, likes, location, friend list and other information described in the social media application sign-up page). 

When you register with us, you can view your personal information in 'My Account'. You can access 'My Account' directly to change any personal details, for example if you move and want to change your address.

Information we collect about you. With regard to each of your visits to our Site, we use the following various technologies to automatically collect personal information about you: 

  • Cookies: these are small bits of information that are placed on the hard drive of your computer. Cookies remember information about your activities on the Site to make your visits to our Site more enjoyable and valuable by providing a customized experience and recognizing your preferences.  If you've chosen to disable cookies on your browser, some of the functionality of our Site may be lost. Certain of our web pages, particularly those that require a login and password, require that cookies be enabled in your browser and cannot be used when you have disabled cookies in your browser.   • Web server logs: these are records of activity created by the computer that delivers the webpages you request to your browser. For example, a web server log may record the search term you entered or the link you clicked to bring you to a webpage on our Site. The Web server log also may record information about your browser, such as your IP address and the cookies set on your browser by the server.
  • Geo-location technologies: this refers to technologies that permit us to determine your general location. We may ask you to manually provide location information on our Site, or to enable your mobile device to send us general location information.  We may also automatically collect general location information from your web browser.

Information we receive from other sources. We may receive information about you if you use any of the other websites we (or any member or brand within our group) operate or other services we provide. In this case we will have informed you when we collect that data that it may be disclosed internally and combined with data collected on this Site.  We are also working closing with third parties (including, for example, business partners or sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and may receive information about you from them.   

What we do with the information 

We use your personal information in the following ways:

  • Administration and improvement of our Site: The information you give us is necessary to enable us to (i) fulfil your order (whether through purchase or promotion, including acknowledging your order and communicating with you if there is any issue regarding the fulfilment of your order), (ii) to make sure your order is delivered correctly, and (iii) to maintain your account. We also use personal information to improve the services on our Site.
  • Customer service: We ask for your contact details, such as your email address and telephone number, to enable us to answer any questions you have about using our Site and to notify you about the status of your orders.

Disclosure of your information

We disclose, or have in the past 12 months disclosed, the personal information listed above for the following business purposes:

  • Affiliated Companies: We may disclose your personal information with any member or brand within our Group. Please visit www.manzanitacapital.com for more information about which members and brands constitute our Group. They may use the information in accordance with their privacy policies for purposes such as for: financial reporting and analysis; strategic planning; the development of customer segmentation and metrics to provide a consistent view of our customer base; the creation of inspiring content and editorial features, and the development and sale of new products and collaborations to enhance your experience as a customer of SB or other brands in the Group.
  • Third Parties: From time to time we retain the services of third party companies and individuals to perform functions on our behalf in connection with the successful operation and continuous improvement of this Site. We may disclose your information with selected third parties, including:
    • Business partners, suppliers and sub-contractors for the performance of any contract we enter into with them or you (e.g. in order to process your order and maintain your account, including the authorization and validation of credit or debit card transactions, the provision of delivery services, the analysis of data, etc.). These companies or individuals may be provided with access to your personal details in order to fulfil their function but may not use such information for any other purpose.
    • Advertisers and advertising networks that use the personal information to select and serve relevant advertisements to you and others. 
    • Analytics and search engine providers that assist us in the improvement and optimization of our Site.
  • Corporate Transactions: In the event that we sell or buy any business or assets, we may disclose your personal information to the prospective seller or buyer of such business or assets. Relatedly, if Space Brands USA LLC (or its ultimate parent company) or substantially all of its assets are acquired by a third party, the personal information held by it may be disclosed in the transaction.
  • Other Parties: If we are under a duty to disclose your personal information in order to comply with any legal obligation, or in order to enforce or apply our terms of use and other agreements; or to protect our rights, property, or safety (or the rights, property, safety of our customers, or others), we will disclose your personal information. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

INTERNATIONAL TRANSFERS

The personal information that we collect from or about you may be transferred to, and stored at, a destination outside of the country in which it was originally collected. This may include transfers outside of United States and into the European Economic Area (EEA). It may also be processed by staff working outside of the United States who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal information, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy and applicable law.

SECURITY AND RETENTION

We use the latest encryption technology to ensure that all transactional information you provide to us is protected to in accordance with industry standards. Transactional information includes any credit or debit card details, your personal contact information, together with any other names and addresses you provide when you place an order for delivery to another address, and your purchasing history. If you have given your consent prior to entering the details required for the ordering process, our Site will retain your Eve Lom account details such as your name, address, email address and purchasing history. Each time you log into your Eve Lom account to create a new order you must re-enter your credit card details. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to disclose a password to anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of personal information transmitted to our Site; any transmission is at your own risk. Once we have received your personal information, we will use strict procedures and security features to try to prevent unauthorized access.

We will retain the personal information we collect from or about you until you elect to no longer receive communications from us, or until we have fulfilled the purpose for which we collected your personal information.

Third party websites 

Our Site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal information to these websites.

Rakuten Advertising may collect personal information when you interact with our digital property, including IP addresses, digital identifiers, information about your web browsing and app usage and how you interact with our properties and ads for a variety of purposes, such as personalization of offers or advertisements, analytics about how you engage with websites or ads and other commercial purposes. Email and SMS Opt-Out

You can opt-out of marketing communications at any time (i) by mail by following the instructions that are included in a particular promotion, (ii) by email by clicking on the unsubscribe link within the marketing emails you receive from us, or (iii) by SMS by following the "STOP" instructions provided in the message. If you have registered with us, you also may opt out of receiving marketing materials (by mail, email and/or SMS) by logging into your account and changing your preferences.

By subscribing to Eve Lom text notifications, you agree to receive automated marketing text messages from us about our products and services at the phone number you provided when you subscribed, and that the messages may be sent via automatic telephone dialing system or other technology. Message frequency is recurring. Consent is not a condition of purchase. Message and data rates may apply. Reply STOP, END, CANCEL, UNSUBSCRIBE or QUIT to opt-out and HELP for customer support. You may receive an additional text message confirming your decision to opt-out.  You understand and agree that attempting to opt-out by any means other than texting the opt-out commands above is not a reasonable means of opting out.

DO NOT TRACK Under California law, website and online service operators are required to disclose how they respond to web browser "do not track" signals or other similar mechanisms. These are mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information over time and across third party websites, to the extent the operator engages in that collection.  At this time, we do not recognize Do Not Track signals, but take steps to recognize commercially reasonable universal opt-out signals.

Depending on where you are located (e.g., California, Colorado, Delaware, Texas, Virginia), you may have the following rights regarding your personal information.

2. Right to Request Deletion

You have the right to request that we delete any personal information that we have collected from you. However, there are several exceptions to this right, such as that we may not be required to delete your personal information in limited circumstances.

We do not and have not in the preceding 12 months, sold your personal information for monetary consideration. However, we have shared (in this context, “share” means use of your personal information for cross-contextual behavioural advertising) your personal information. You may opt-out of the sharing of your personal information by updating your cookie preferences or by contacting us by following the instructions below.  Also, it may be considered a "sale" of personal information under applicable law when we disclose names, email addresses, phone numbers, general location information, and browsing activity on our website to advertising networks. You may opt-out of the “sale” of your personal information by following the instructions below.

Depending on where you are located, you may also have the right to submit your request through an authorized agent. NOTICE OF FINANCIAL INCENTIVE

We offer our customers a coupon program that provides certain perks, such as discounts, promotions, and exclusive offers (collectively, the “Program”). The Program may be interpreted to be a “financial incentive” or “bona fide program” under certain state law. The Program is subject to separate terms which are made available to you when you register for the Program.

We collect the categories of personal information described above for the purpose of providing the Program, and may disclose such personal information to the third parties listed above. Some of our disclosures of personal information collected through the Program may constitute “sales”, “sharing”, or “targeted advertising” (as defined under applicable law).

We estimate the value of your personal information to us to be reasonably related to the value provided to Program participants via the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants. We do not assign independent monetary value to personal information collected in connection with the Program. The precise value each participant receives from the Program can vary by individual and depends on (without limitation) the (a) amount of discounts redeemed, (b) number of offers accepted, and (c) whether someone is a regular or occasional customer.

You may withdraw from participating in the Program at any time by contacting us as described below.

CHILDREN

We do not knowingly or intentionally collect any personal information from children under the age of 16, nor do we sell (as the term is defined by applicable law) the personal information of children under 16. If we become aware that we have inadvertently received personal information from a visitor under the age of thirteen on the Site, we will take steps to delete the information from our records.
